01 - Identification of the Parties
The terms and conditions of use described herein constitute the binding agreement between "you" and "us". The terms "you" and "the user" refer to the person who uses the site or the company or organization that has mandated him to do so. The term "we" or "us" refers to "PromoRabais" a division of Urban Life Media Inc. and "PromoRabais" and the "site" owned and operated by PromoRabais.
02 - Acceptance of terms and conditions of use
The right to use this site is granted to you only on the express condition that you accept the terms and conditions set forth in this document. It is therefore important that you read and accept them before using the site. By using the Site, you accept these terms and conditions and agree to comply with them. If you do not agree to these terms and conditions, please do not use the Site, as you will be making unauthorized use of it.
03 - Description of the site's services
Vie Urbaine operates a website promorabais.com that offers, to its community of users, interactive online services that allow them to identify and structure their social and cultural interests, share them with their friends on social networks, and receive suggestions and opportunities in line with those interests ("the services"). The Services also include, more specifically, the display of special offers from various merchants and electronic transactional support for the acquisition of these merchants in the form of discounted coupons that can be used for the acquisition of goods and services in their business or establishment. However, PromoRabais's services do not in any way include the delivery of goods and services to which the vouchers give access, which are offered separately and independently by the merchants themselves.
04 - Transactional services for the acquisition of merchant vouchers
By using PromoRabais services you agree to the following rules: * You must register and provide us with certain personal information necessary to allow payment of your purchase, printing of your voucher, viewing and adjustment of your profile. * When you click on the "Buy" icon you agree to purchase a voucher redeemable for goods and services from the merchant, provided that the minimum number of buyers set by the merchant is reached * Your purchase will only be confirmed if this minimum number of buyers is reached before midnight on the day the offer expires. If confirmed, your credit card will be charged and we will email you your voucher for you to print. If the minimum number of buyers is not reached, the offer is canceled and no charge will be made to your credit card. * You acknowledge that the voucher seller is the merchant and is solely responsible for honoring this voucher and its terms and conditions, delivery of goods and provision of services to which the voucher gives access. * Use of the vouchers is subject to the specific terms of redemption set forth by the merchant and indicated on the voucher or on the site. Use is also subject to the following general conditions: the voucher cannot be combined with any other promotional offer, the voucher cannot be reproduced in any way, neither PromoRabais nor the merchant are responsible for the loss or theft of a voucher. The merchant has committed to PromoRabais to honor its Vouchers and the conditions associated with them. PromoRabais users who experience difficulties in redeeming their vouchers in accordance with the terms and conditions may submit their complaints to PromoRabais by email at [email protected]. PromoRabais will do its best to help you resolve the situation with the merchant.
05 - Limitations of Liability
The user agrees to use the site "as is" and "as available" at his or her own initiative and risk. Subject to applicable law, PromoRabais makes no representations or warranties, express or implied, as to functionality, quality, non-infringement, uninterrupted or error-free access and freedom from computer viruses. The same limitations of liability apply to the content of the site, the information, products and services posted on it. Vie Urbaine shall not be liable in any way for direct, indirect, punitive or consequential damages arising out of the use of or inability to use this site. Notwithstanding the foregoing, should PromoRabais be held liable, PromoRabais's liability to you or any third party shall in no event exceed the value of the purchase price of the Voucher. In particular, PromoRabais makes no representations or warranties and disclaims all liability for the delivery of goods and services to which the vouchers give access, which are offered separately and independently by the merchants themselves.
06 - Prohibition of unlawful use of the site
You must use this site and ensure that the use of your secure account on this site is legal and respectful. In this sense, you are prohibited from submitting content that is hateful, obscene, pornographic, defamatory, libelous, abusive, vulgar, threatening, not respectful of human rights, not respectful of public or private rights, in violation of intellectual property rights or any other law. PromoRabais may remove at any time any information transmitted or posted by you on its site that it deems to be in violation of this paragraph, at its sole discretion and without prior notice.
07 - Indemnification
The user agrees to indemnify and hold harmless PromoRabais, its affiliates, directors, officers and employees from and against any and all claims for damages and expenses submitted to them by a third party as a result of a breach of these terms by you or users of your account.
08 - Truthful Information, Password and Account Security
You agree to provide truthful and up-to-date information when registering and subsequently using our site. You are responsible for maintaining the confidentiality of your account passwords, as you are solely responsible for actions taken under your account.
09 - Acknowledgement of Electronic Communications
You acknowledge that any electronic communications we issue to you satisfy any legal requirement that such communications be in writing.
10 - Automatic right of use
When you submit information and content to our site, you automatically grant us a license to use, or warrant that the owner of the rights grants us a non-exclusive, perpetual, worldwide, royalty-free license to use all such materials and content for any purpose.
11 - Trademarks
You may not use any trademark displayed on this site without the written permission of PromoRabais or the owner of such trademark. "PromoRabais" "PromoRabais" "Cities Connected" are trademarks owned by Urban Life Networks Inc.
12 - Access to external sites
Certain links available on this site allow you to access Internet sites that are not managed by PromoRabais. We are providing these links to you only as a convenience and make no warranties, representations or endorsements of any kind with respect to these websites. PromoRabais assumes no responsibility for the content of third party websites. Please be aware that your access to these external third party websites is at your own risk.
13 - Privacy Policy
PromoRabais's privacy policy regarding the confidentiality of professional information is presented on the site. You can consult it by accessing https://promorabais.com/en/help/privacy-policy.html. This policy is an integral part of this agreement and is binding on you.
14 - General terms and conditions
The present terms and conditions constitute the complete and final agreement between PromoRabais and you regarding the use of our services. The fact that a clause of this agreement is cancelled or invalidated by a court of competent jurisdiction will not affect the validity of all other clauses of the agreement. The Vie Urbaine.com site is hosted and operated by Vie Urbaine Networks inc. in its offices located in Montreal, province of Quebec, Canada. Also, the parties agree that this agreement is entered into in Montreal and that any dispute shall be submitted exclusively to the Courts of Quebec, in the judicial district of Montreal. This Agreement and its interpretation shall be governed by the laws of Quebec and the federal laws of Canada applicable therein.
15 - Refund Policy
The offer is acquired by the customer directly from the merchant although the transaction is done on the PromoRabais group purchasing platform. It is therefore the merchant's responsibility to provide the customer with the service to which he/she has committed in accordance with the terms and conditions set out in the published offer, or to compensate or refund the customer accordingly. Vie Urbaine offers users of its platform a sustained customer service to ensure that merchants who publish offers on its platform respect these commitments. This support is reflected in the following refund policy.
16 - Refund period guaranteed by PromoRabais
For a period of 15 days following the date of purchase of a coupon on its platform, Vie Urbaine will reimburse the amount disbursed by the buyer of the coupon, without the latter having to justify in any way his request for reimbursement, provided of course that the coupon has not already been used or has not expired.
17 - Subsequent period of support for claims
After this period, PromoRabais undertakes to support its users in any legitimate and motivated claim, to a merchant, aiming either to ensure that the service is rendered in accordance with the terms and conditions of the offer, or to request a refund for services not rendered. Each request will be evaluated on its own merits and PromoRabais will do its utmost to ensure a fair settlement by the merchant of any request for reimbursement by the users of its platform.
